Hacemos presente que las ventas en esta web sólo se realizan a profesionales, no es una venta a particulares, con lo que no es de aplicación la ley Ley 23/2003, de 10 de julio, de Garantías en la Venta de Bienes de Consumo, dada la aplicación de la misma a los particulares y no a las actividades comerciales B2B.

Access, browsing and use of the Website confers the condition of user, and as such, from the moment you start browsing, you accept all the Conditions established here, as well as any subsequent modifications, without prejudice to the application of the corresponding legal regulations of obligatory compliance as the case may be.

The User assumes responsibility for the correct use of the Website. This responsibility extends to:

• Use this Website only to make legally valid enquiries and purchases or acquisitions. 
• Do not make any false or fraudulent purchases. 
• To confirm that all data provided are truthful and lawful.

The User declares that he/she is over 18 years of age and/or has the legal capacity to enter into contracts through this Website.

The Website is primarily intended for Professional Users in the hospitality industry residing in the EU and is governed by Spanish legal guidelines, and Hosteocasion™ makes no representation that the Website complies with the laws of other countries, either in whole or in part.

3. Applicability of general conditions

These terms and conditions apply to all quotations, offers, activities, agreements and deliveries of products by or on behalf of Hosteocasion™.

Deviation from these conditions is only possible if the parties have explicitly agreed in writing. 

4. Object

These terms and conditions shall govern the use of the Hosteocasion™ website and online shop as indicated above, making them available to its users and customers.

Purchases in https://hosteocasion.es/  can be placed from any part of Spain through these conditions, which would vary if the order is placed from any other EU country.. Los productos y servicios que Hosteocasion™ vende a través de su página web son, principalmente: maquinaria nueva y/o usada y revisiada para la Hostelería y para profesionales del sector HORECA.

These General Terms and Conditions have been drawn up in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, the RGPD EU 2016/679, its Spanish transposition, the LOPD-GDD 3/2018 and the Spanish Civil Code.

Informarles que debido a que la relación contractual es de profesional a profesional, Hosteocasion™ está exonerada del cumplimiento del Real Decreto Legislativo 1/2007, de 16 noviembre y su reglamento, Real Decreto 306/2019, de 26 de abril, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, la Ley 23/2003, de 10 de julio, de Garantías en la Venta de Bienes de Consumo y otras leyes complementarias, todas ellas disposiciones legales de obligada aplicación para particulares.

Hosteocasion™ podrá modificarlas sin previo aviso, de manera que recomienda una periódica consulta de las mismas, más aún cuando se disponga a hacer un uso efectivo de su tienda online. No obstante, Hosteocasion ™ se compromete siempre a tenerlas actualizadas, a publicar la última versión y permitir su acceso e impresión en cualquier momento.

Use of Images

Hosteocasion™, uses its own images and those of third parties by means of a contract of use tender, which are copyrighted by the owner firms.

The contents may not be copied, modified, reproduced, communicated to the public, presented, distributed or used in any other way for commercial purposes.

It is authorised for the use for which it has been contracted exclusively.

Ownership is not transferredThe design may not be used in third-party products, not made by its owner.

The user acknowledges that the images they may receive are protected by intellectual, industrial or other property rights and that any use of these images in violation of these rights will be prosecuted in accordance with current legislation.

5. Conditions of access and purchase

El acceso al Portal de Hosteocasion™ es libre y atribuye a quien lo realiza la condición de Usuario, independientemente del posterior uso de los servicios ofrecidos.

Hosteocasion™ undertakes not to allow any transaction that is illegal, or is deemed by the credit card brands or acquiring bank, that may or has the potential to damage their goodwill or negatively influence them.

The following activities are prohibited under the card brand programmes: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or payment platforms.

El Usuario deberá facilitar sus datos profesionales con el objeto de comprar en nuestra tienda debiendo proceder a la cumplimentación de un formulario, lo que podrá comportar asignar unas credenciales personales compuestas por un identificador único (como podría ser la dirección de correo electrónico) y una contraseña, cuya conservación y custodia dependerá exclusivamente del Usuario, quien deberá operar con ellas con la diligencia debida. Por lo tanto, no utilizará otras claves que no sean las suyas, con el objeto de suplantar a otros Usuarios en la utilización de la web y sus servicios.  

The purchase of the products in https://hosteocasion.es/  may only be made by users with the legal capacity to make purchases according to current legislation, who must follow the steps and instructions that will accompany the entire purchase process, consisting of, but not limited to, the following:

(i) Completion of the registration form or the identification form for previously registered users;

(ii) On-screen display of the order summary, delivery conditions and - if applicable - shipping costs;

(iii) Acceptance of purchase conditions, which implies the reading, understanding and irrevocable acceptance of each and every one of the present General Conditions, as well as, if applicable, of the existing Special Conditions, and

(iv) Immediate receipt of summary e-mail to the account used for registration or - failing that - as soon as possible and always within twenty-four hours.

It is not permitted to purchase products or services in the following ways https://hosteocasion.es/  for subsequent distribution or resale, either in public establishments or in the domestic sphere, except in the case where there is an express written agreement with Hosteocasion™ , for which it will regulate and authorise the necessary permits if at any time it consents to it, so it would notify the authorised agent of such authorisation.

6. Orders

No valid order can be placed without expressly accepting, through the boxes provided for this purpose, the terms and conditions and privacy policy of Hosteocasion™.

All orders shall be considered offers to purchase subject to these terms and conditions, where Hosteocasion™ reserves the right to accept the same if the requirements of these terms and conditions are not met.

Once an order has been placed, the system automatically generates a confirmation of receipt of the order, assigning an order number. However, this confirmation does not imply automatic acceptance of the order, as Hosteocasion™ reserves the right to collect additional information related to identity and address to guarantee both the correct delivery of the order and to ensure the absence of fraud related to transactions.

Orders can be placed 365 days a year, at any time, except at times when the service is suspended for maintenance or other commercial circumstances and/or force majeure.

Any order is subject to temporary availability of the product.

7. Delivery

Delivery shall be deemed to have taken place when the user or a third party indicated by the user acquires material possession of the products.

El plazo de entrega para el pedido variará según la tipología de servicio que se tenga que realizar y el método de envío seleccionado, comunicándose previamente mediante correo electrónico u otro medio de comunicación designado para la concreción del mismo.

If the addressee is absent at the time of delivery, a notice will be left so that he/she can pick up the shipment at the place and within the time indicated. After the deadline has passed without collection, the shipment will be returned to Hosteocasion™.

8. Price and payment

Se entiende que el precio de cada producto es el que aparecerá en la página web, El usuario deberá abonar el precio marcado, el cual se expresa únicamente en Euros €, incluyendo los impuestos aplicables, junto con los gastos de envío que se pactarán en las comunicaciones posteriores, que se añadirán al precio final a pagar. 

Prices may be changed by Hosteocasion™ at any time and without prior notice without affecting orders already confirmed. However, even if confirmed, Hosteocasion™ shall not be obliged to honour orders when the price is incorrect, especially when the error is manifest and easily recognisable.

The accepted means of payment are: 

Payment by credit or debit card via Virtual POS through the platform of Banco Santander (through its platform https://www.getneteurope.com/es/politica-de-privacidad), where the parties reserve the right NOT to accept certain payments with certain credit cards,

Payment by credit/debit card: The charge is made online, i.e. in real time, through the payment gateway of the corresponding financial institution and once it has been verified that the data provided are correct.

Giving maximum security to the payment system https://hosteocasion.es/  Hosteocasion™ uses secure payment systems of leading financial institutions in e-commerce. In this sense, confidential data is transmitted directly and in encrypted form (SSL) to the corresponding financial institution. The SSL encryption system used confers total security to the transmission of data through the network. Customer data are fully confidential and protected. Credit card details are not recorded in any of our databases. They are only used in the virtual POS (Point of Sale Terminal) of Hosteocasion™'s financial institution, through its Secure Payment Gateway. Credit cards will be subject to verification and authorisation by the credit card issuer, but if the credit card issuer does not authorise payment, Hosteocasion™ is not responsible for any delay or non-delivery and will not be able to enter into any Contract with the customer. Hosteocasion™ reserves the right to verify the personal details supplied by the customer and to take any action it deems appropriate (including cancellation of the order) to ensure that the goods purchased are delivered in accordance with the details on the order. 

Hosteocasion™ reserves the right to change the payment methods, and may create new ones or eliminate any of the existing ones, without the user/customer being able to make claims for this reason. However, if the change in the payment method affects an order already placed, Hosteocasion™ will contact the customer to inform him/her of the change, offering him/her the different possible options.

9. Right of withdrawal, incidents and refunds

Withdrawal

Debido a que la contratación de nuestros servicios corresponde principalmente a maquinaria de segunda mano para profesionales, que los costes de los mismos no entran dentro del apartado de elementos comodity y que el coste de los portes puede llegar a ser elevado debido a volúmenes y pesos y de acuerdo con al artículo 103 del Real Decreto Legislativo 1/2007, Hosteocasion™ queda exonerada del derecho de desistimiento por parte del cliente. Si bien, antes de la realización del pedido en firme, se habrán realizado todas las pruebas pertinentes para su aceptación, una vez aceptada dicha prueba no se admiten devoluciones relacionadas con el diseño del producto aprobado, indicándoles de ante mano que las imágenes en pantalla pueden difierir de la realidad, principalmente debido a la utilización de fotografías de pequeño tamaño que pueden no reflejar todas las situaciones del bien solicitado.

En el caso de incidecia con el material comprado, el usuario debe de realizar una comunicación inmediata con nuestra plataforma de atención a cliente a través del correo info@hosteocasion.com con toda la información posible sobre la misma, inmediatamente nos pondremos en contacto con usted para intentar solucionar la incidencia y evaluar la acción a realizar, dilucidando quien es el responsable directo de la misma y actuando en consecuencia.

En el caso de devolución por garantía, esta se realizará por nuestros medios, si bien se requerirá al cliente que realicen los correspondientes embalajes, al menos con los mismos niveles de seguridad y protección que los que recibió en el momento de la entrega.

En el caso de devolución directa por el cliente y dado que los portes están pactados para el envío, estos no podrán superar el coste de los de envío y serán a cargo del cliente.

10. Guarantee

Due to the fact that the items sold on this website are second hand, Hosteocasion™ is exempt from extending the manufacturers' own warranties, which may have expired at the time of sale, however, Hosteocasion™ gives an additional 1 month warranty from the time the order is received by the customer.

GARANTÍA MAQUINARIA NUEVA

1. A) CONDICIONES GENERALES DE LA GARANTÍA DE MAQUINARIA NUEVA
2. Toda maquinaria nueva tendrá la garantía ofrecida por el fabricante y detallada en la documentación adjunta a la máquina. Por lo general, la garantía del fabricante de maquinaria industrial cubre durante el plazo de un año a partir de la fecha de recepción del la máquina.
   2. La garantía solo ampara defectos de fabricación y piezas defectuosas, las cuales se canjearán una vez verificadas.
   3. EXCLUSIONES DE LA GARANTÍA – Queda excluido de la cobertura de la garantía, y por tanto será a cargo del usuario el coste de las horas de la reparación, transporte y desplazamiento, en los siguientes casos:

• 3.1. La averías provocadas por negligencia o mal uso del aparato por parte del consumidor.
• 3.2. Las averías producidas por causas de caso fortuito, fuerza mayor (fenómenos atmosféricos o geológicos) y siniestros.
• 3.3. Las intervenciones que se deriven de una instalación incorrecta o de la falta de mantenimiento.
• 3.4. La aplicación de productos químicos inadecuados o la acumulación de residuos, tales como grasa o cal, originada por falta de limpieza.
• 3.5. La ubicación incorrecta de la máquina
• 3.6. Los desgastes o deterioros estéticos producidos por el uso

4. El servicio de instalación, mano de obra, reparación o mantenimiento posterior correrá a cargo del comprador exclusivamente.
   5. La garantía únicamente se responsabiliza de materiales o piezas, no haciéndose cargo en ningún caso de indemnización alguna.
   6. Los materiales de reposición se enviarán siempre por cuenta y riesgo del comprador, y serán facturados al mismo.
   7. Sustituida la pieza, el comprador remitirá la defectuosa a la empresa vendedora para verificar la avería y validar la garantía con el fabricante.
   8. Una vez verificado, maquinariahosteleria.es hará el abono correspondiente y la devolución del dinero al comprador.

GARANTÍA MÁQUINAS DE SEGUNDA MANO

1. B) CONDICIONES GENERALES DE LA GARANTÍA DE MAQUINARIA DE SEGUNDA MANO

1. Toda máquina usada o de segunda mano tendrá la garantía extraordinaria a la garantía del fabricante, que cada equipo puede tener una diferente y que posiblemente en el momento de la venta del product esté extinta, de 1 mes desde la entrega del producto comprado.
2. Este plazo de la garantía aparecerá perfectamente detallado en la ficha del producto anunciado en esta web (maquinariahosteleria.es).
3. Toda máquina que disponga de garantía, llevará en su interior el documento acreditativo de la misma, con sello y responsabilidad de la parte vendedora.
4. EXCLUSIONES DE LA GARANTÍA – Queda excluido de la cobertura de la garantía, y por tanto será a cargo del usuario el coste de la reparación, en los siguientes casos:

• 4.1. La averías provocadas por negligencia o mal uso del aparato por parte del consumidor.

1. El servicio de instalación, mano de obra, reparación o mantenimiento posterior correrá exclusivamente por parte del comprador.
2. La garantía únicamente se responsabiliza de materiales o piezas, no haciéndose cargo en ningún caso de indemnización alguna.
3. Los materiales de reposición se enviarán siempre por cuenta y riesgo del comprador, y serán facturados al mismo.
4. Sustituida la pieza, el comprador remitirá la defectuosa a maquinariahosteleria.es para verificar la avería y validar la garantía con el fabricante o el vendedor de la máquina.
5. Una vez verificado, maquinariahosteleria.es hará el abono correspondiente y la devolución del dinero al comprador.
6. Toda máquina que disponga de garantía, llevará en su interior el documento acreditativo de la misma, con sello y responsabilidad de la parte vendedora.

11. Devoluciones de mercancías

En el caso de uso de las garantías, desde Hosteocasión™ analizaremos cada caso dependiendo de cual sea la localización geográfica donde se encuentra la mercancía.

Si la maquinaria ha sido instalada por nuestra empresa, la devolución de la misma se realizará por los medios y/o personal de Hosteocasión™ y a su cargo

En el caso de devolución directa por el cliente y dado que los portes están pactados para el envío, estos no podrán superar el coste de los de envío y serán a cargo del cliente.

12. Customer Service

Hosteocasion™ has a customer service department so that users can manage their complaints, queries or requests.

The User may address any complaints, claims or requests for information to the Hosteocasion™ Customer Service Department at info@hosteocasion.com
 

All doubts and especially complaints and suggestions will be dealt with as quickly as possible, without exceeding in any case the deadlines established by current legislation.

It shall also record them by providing written proof, on paper or on any other durable medium.

12. Protection of personal data

Hosteocasion™ complies with current legislation on the protection of personal data, in accordance with Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights and Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

13. Language of the contract

These general terms and conditions of sale are written in Spanish. In the event that they are translated into one or more foreign languages, the Spanish text shall prevail in case of dispute.

14. Applicable legislation

These General Conditions are governed by Spanish law. The parties submit to the courts and tribunals of Alicante for the resolution of conflicts, renouncing any other jurisdiction.
